The popular photo sharing application, Instagram, is being sued after making some controversial changes to its terms of services. The class action suit was filed in a San Francisco court room after several users expressed outrage over the changes made to the app’s TOS. According to Reuters, this is the very first lawsuit that has been filed against the mobile photo app.

An Instagram user from California, Lucy Funes, says that the app committed a breach of contract as she spoke on behalf of herself and other users who were affected by the changes made. Last week, Instagram made an announcement regarding some changes being made to their TOS. This announcement sparked a lot of outrage from several users including famous ones such as National Geographic.

According to the new TOS, Instagram has the right to sell users’ photos without any form of compensation and even introduced a new mandatory arbitrary clause. This new clause would force users to waive their rights to file any kind of class action lawsuit in most circumstances.

Mashable has attempted to get a response from Facebook, the company that purchased Instagram, for a comment regarding the said lawsuit, but so far the social networking giant has yet to respond.
