Curtis Reeves, 71 shoot a man inside a theater in Florida as self defense.
Legal Experts from Florida says Reeves can appeal a "Stand Your Ground" or self-defense as reason for shooting but will have to convince the judge.
Reeves, who was with his wife in the cinema claimed that it was fear for his life or threat over an attack, caused him to shoot the victim.
Bob Dekle, a legal expert says, "It's not whether or not you're in fear. If the standard about shooting were fear that would give cowards carte blanche. The question is was there reasonable fear, was the fear reasonable?"
Reeves claims of self defense or fear has a possibility to win over the case, if he can provide proofs to use the "Stand Your Ground Law".
The reported fatal shooting inside The Grove 16 Theater on Monday was caused by an argument over texting. Chad Oulson, who was texting her 3-year-old daughter while watching a movie had a fight with Reeves and shoot him.
The incident causes Oulson's death and Reeves in jail.
Oulson's wife, who was also inside the cinema with the victim, injured her hand but now in recovery.
Reeves first occurrence in the court happens last Tuesday where Judge Lynn Tepper ordered a second degree murder charge.
Officials at County said it was Oulson who threw popcorn at Reeves that cause the retired captain at Tampa to shoot the victim.
Also, there was an altercation where both Oulson and Reeves exchange words and gone face to face.
Reeves will face life sentences if convicted. He attend court hearing with bullet proof vest and speak only once when he was asked by Judge Tepper if he can afford to hire an attorney saying "yes ma'am".
