A Wal-Mart plastic bag lawsuit has been filed by a Nebraska, claiming that the failure of an overstuffed plastic grocery has led to his wife's early death, The Associated Press reported via Fox News Thursday.
This bizarre Wal-Mart plastic bag lawsuit was first filed by a William Freis of Plattsmouth in Sarpy County in February, but was later on moved to Omaha's U.S. District Court, a Lincoln Journal Star report stated.
According to the report, the lawsuit states that Wal-Mart plastic bag failed just outside of the store in Bellevue on April 16, 2010. The man stated that a cashier had placed a 2-pound bag of rice and two 42-ounce of a La Choy product in a single bag. The cashier handed it over to Lynette Freis, William's wife.
Then, the bag snapped just as Lynette was carrying it towards her car. The lawsuit continued by stating that one of the La Choy cans dropped on the right big toe of the woman, causing a major cut and fracturing it even.
The wound caused an infection that gradually became systemic and spread throughout her body, and although Lynette had taken antibiotics, undergone two surgical procedures, and been hospitalized for quite a time, the simple wound out of the Wal-Mart plastic bag lawsuit, "ultimately resulted in her death on March 12, 2011."
An Examiner report stated that the main reason behind the Wal-Mart plastic bag lawsuit was due to Wal-Mart's failure on "properly training its employees on the dangers of not double-bagging."
The lawsuit also identified the manufacturer of the plastic bag, Hilex Poly Co., of Hartsville, S.C., as well as the distributor of the bag, St. Louis-based Bunzle Distribution.
The Wal-Mart plastic bag lawsuit demands for nearly $657,000 to cover the medical and funeral expenses and an unspecified charge for the pain and suffering of the husband after his wife's death.
Wal-Mart is seeking to move the case to the federal court as of late.
Randy Hargrove, Wal-Mart spokesperson said, "customer safety is a top priority, and we take it seriously any time an injury is reported in one of our stores," after extending his condolences to Mr. Freis.
