A Texas father who had beaten his daughter's rapist to death in June will not be charged with murder, officials say in a statement earlier this month.
The father, 24 years old, had run towards his daughter's screams after a witness alerted him that a farm helper, Jesus Mora Flores, 47, had dragged his five-year-old daughter towards a remote barn on the family farm.
The young father caught Flores with his pants and underwear down before pulling him off his daughter and "inflicting blows on his head and neck."
He beat the pedophile unconscious, but did not hesitate to call 911 after realizing that he was dying.
"Come on. This guy is going to die on me! I don't know what to do!" He tells the 911 operator, alarmed and panicking because he did not know where the ranch was located.
Flores' death is being investigated as a homicide, but a US Grand Jury decided against charging the young father with murder after hearing records of his 911 phone call.
Under Texas law, "deadly force is authorized and justified in order to stop an aggravated assault or sexual assault"
The five-year -old girl, according to forensic evidence, was tested positive for rape.
Local authorities as well as local townsfolk have defended the father's actions, some saying that the rapist "deserved it big time."
"You have a right to defend your daughter," Sheriff Micah Harmon told the media in June. "The girl's father acted in defense of his third person. Once the investigation is completed we will submit it to the district attorney who then submits it to the grand jury, who will decide if they will indict him."
The father's attorney, V'Anne Huser, has repeatedly told reporters that her client and his family have no intention to give interviews. The father and his family's identities have remained anonymous for their protection.
"He's a peaceable soul," Huser said. "He had no intention to kill anybody that day."
