Justin Bieber was ordered to appear before the court for his deposition in L.A. on Thursday, Jan. 23, but the 19-year-old did not show up.
Earlier that day, Justin Bieber was apprehended in Miami for drag racing and driving under the influence, with additional charges for resisting arrest without violence and operating a motor vehicle with an expired license.
California resident Justin Bieber paid the US$2,500 bail and left prison just a few hours after being taken in.
Jeffrey Binion, a professional photographer, filed a suit against the 19-year-old pop star and his bodyguard, Hugo Hesny last year for alleged battery.
Binion's attorney, Mark DiCowden, was informed on Jan. 22 that Bieber would not be present at the scheduled hearing. The singer's videotaped deposition was scheduled to take place at 10 a.m. the following morning at attorney Howard Weitzman's office.
An hour before the schedule start time, the teen's lawyer filed an emergency motion to halt the deposition but the request was denied, according to DiCowden.
"The court had ordered Justin Bieber to appear," the lawyer said in an interview. "Essentially, we were all ordered to appear."
DiCowden was informed Thursday that Justin Bieber was arrested and thus unable to appear.
"I was told as of last evening that they weren't going to produce him anyhow," DiCowden explained. "I am disappointed it didn't go forward as scheduled but not surprised."
Justin Bieber has not yet given his response to the issue.
The lawyer added that he will seek to get reimbursed for the cost of flying from Miami to L.A.
