"As long as the act is not directed to a particular person, then that would not be considered as sexual assault", Atty. Roland Smith of Ford Sweden Law Firm said. Hence a recent sexual assault case was dismissed due to masturbation in public area.
The 65 year old man was acquitted for doing masturbation in beach in Stockholm last June. The district court of Sodertorn declared the man as "not guilty" for sexual assault, as he did not look directly to someone or address the act to someone while doing the malicious act.
Public prosecutor Olof Vrethammar released his statement during his interview at Matti news paper, which they do not intend to bring the case in higher court for an appeal. He added that, although they said that the incident does not qualify as a sexual assault but, it can be considered as a "disorderly conduct".
The said incident earns various reactions from the social media networking site such as twitter and Facebook. Some users said that the act is obviously unethical, and Sweden should take an action about it.
"Masturbation in public places should be consider as morally wrong, as the act will reflect to the moral standard of a certain country", Diana Rose, sociologist said.
On the other hand, some agrees to the decision of the court to acquit the man as the act committed does not harm anyone, "for me, authorities must focus more on serious crime such as murder, vehicular accident, rape and other social crimes, as they are increasing heavily, let's not waste our time with this", Amado Angelo, news columnist said.
As of the moment, the authorities do not have plans on elaborating the said issue, as it was already considered as closed.
